Brokervio Privacy Policy

Brokervio ("Brokervio," "we," "us," or "our") provides a software platform for licensed real estate professionals covering offer creation, electronic signatures, and transaction management (the "Service"). This Privacy Policy explains how we collect, use, disclose, and protect information when you use the Service or visit our website.
By using the Service, you agree to this Privacy Policy. If you do not agree, do not use the Service.
1. Who This Policy Covers and Our Role
Account Holders ("Users"): Licensed real estate agents, brokers, and their team members who create Brokervio accounts. For your account and usage data, Brokervio acts as the data controller.
End Clients ("Client Data"): Buyers, sellers, and other parties whose information Users enter into the Service, including names, contact details, property information, offer terms, and signed documents. For Client Data, Brokervio acts as a data processor or service provider acting on the User's instructions. The User, not Brokervio, is responsible for having a lawful basis to collect and enter Client Data, including obtaining any required consents.
2. Information We Collect
Information you provide:
- Account information: name, email address, phone number, brokerage name, license number, and state of licensure
- Branding materials: logos, colors, and business information you upload for white-label customization
- Payment information: processed by our third-party payment processor; Brokervio does not store full payment card numbers
- Client Data: information Users enter about transactions, parties, and properties, including documents uploaded or generated within the Service
- Electronic signature data: signature images, signer names, email addresses, timestamps, IP addresses, and audit trail records created during signing events
- Communications: messages you send to our support team
Information collected automatically:
- Usage data: pages viewed, features used, actions taken, timestamps
- Device and connection data: IP address, browser type, operating system, device identifiers
- Cookies and similar technologies: used for authentication, session management, preferences, and analytics (see Section 9)
Information from third parties:
- Mapping and address data from Google Maps services when you use address lookup features
- Delivery status data from our SMS provider when text messages are sent through the Service
3. How We Use Information
We use information to:
- Provide, operate, maintain, and improve the Service
- Create and manage accounts, authenticate Users, and enforce tenant-level data isolation
- Generate offers, contracts, invoices, and other transaction documents at the User's direction
- Facilitate electronic signatures and maintain legally required audit trails
- Send transactional communications, including e-signature requests, showing notifications, and account notices
- Send SMS messages only as described in Section 5
- Process payments and manage subscriptions
- Monitor for, prevent, and address fraud, abuse, security incidents, and technical issues
- Comply with legal obligations
- Analyze usage in aggregated or de-identified form to improve the Service
We do not sell personal information. We do not share personal information for cross-context behavioral advertising.
AI processing: Where the Service includes features powered by artificial intelligence, relevant information may be processed by AI models operated by us or by our service providers solely to provide the requested feature. We do not permit AI service providers to use your information to train their models, and we contractually restrict their use of your data to providing services to us.
Data residency: Personal information is primarily stored and processed within the United States.
4. Tenant Data Isolation
The Service is built as a multi-tenant platform with data isolation enforced at the database layer. Each User's data, including Client Data, is logically segregated so that other Users of the Service cannot access it. No security architecture can guarantee absolute isolation, but this design is a core requirement of the platform.
5. SMS and Text Messaging
Where the Service sends SMS messages (for example, showing reminders or signature requests), messages are sent through a registered messaging provider in compliance with carrier A2P 10DLC requirements.
- Message recipients must have provided consent to receive messages, either directly or through the User who initiated the message
- Recipients can opt out at any time by replying STOP
- Message and data rates may apply
- Users are responsible for obtaining valid consent from their clients before triggering SMS communications through the Service, including compliance with the Telephone Consumer Protection Act (TCPA)
6. How We Share Information
We share information only in the following circumstances:
Service providers (sub-processors): We use third-party providers to operate the Service, including cloud hosting and database infrastructure, SMS delivery, mapping services, payment processing, and email delivery. These providers are bound by contractual obligations to protect information and use it only to provide services to us. A current list of sub-processor categories is available on request at privacy@brokervio.com, and a Data Processing Addendum is available for brokerage and enterprise accounts that require one.
Within your tenant: Information is visible to other authorized users within your own brokerage or team account according to the permissions you configure.
Transaction parties: Documents and signature requests are shared with the parties the User designates, such as buyers, sellers, cooperating agents, and attorneys.
Legal requirements: We may disclose information if required by law, subpoena, court order, or governmental request, or where necessary to protect our rights, users, or the public.
Business transfers: If Brokervio is involved in a merger, acquisition, financing, or sale of assets, information may be transferred as part of that transaction, subject to this Policy or one that is at least as protective.
With your direction or consent: We share information when you direct us to or otherwise consent.
7. Data Security
We maintain a data security program with administrative, technical, and physical safeguards reasonably designed to protect personal information, consistent with the New York SHIELD Act and other applicable laws. Safeguards include encryption of data in transit, encryption of stored data at rest where supported by our underlying infrastructure, access controls, tenant-level database isolation, and logging. Security and access logs are retained as described in Section 8 and are used to detect and investigate fraud, abuse, and unauthorized access. No method of transmission or storage is completely secure, and we cannot guarantee absolute security. If a breach of security affecting your personal information occurs, we will notify you and applicable regulators as required by law.
8. Data Retention
We retain personal information for as long as your account is active or as needed to provide the Service, and thereafter according to the following schedule, unless a longer period is required by law or needed to resolve disputes or enforce agreements:
- Account and profile information: duration of the account plus 3 years
- Customer Data and transaction documents: duration of the account plus 90 days, during which Users may export their data; Users may delete individual records at any time during the account term
- Signed documents and e-signature audit trails: 7 years from execution, to preserve the enforceability of signed documents and support statutes of limitations applicable to real estate transactions
- Billing records: 7 years, for tax and accounting compliance
- Server and security logs: up to 24 months
- Support communications: 3 years
When retention periods expire, we delete or irreversibly de-identify the information. Deleted information may persist in encrypted backups for a limited period (typically up to 90 days) before being permanently purged through routine backup rotation. Users may export their data before account closure.
9. Cookies and Analytics
We use essential cookies for authentication and security, and functional cookies to remember preferences. We may use analytics tools to understand how the Service is used. You can control cookies through your browser settings, but disabling essential cookies will prevent the Service from functioning.
10. Your Privacy Rights
Rights for all US residents: Regardless of which state you live in, Brokervio extends the following rights to every user in the United States:
- Right to know: what personal information we collect, the purposes, and the categories of third parties with whom we share it
- Right to access: obtain a copy of your personal information in a portable format
- Right to correct: fix inaccurate personal information
- Right to delete: request deletion of your personal information, subject to legal exceptions such as records we must keep for signed-document integrity, security, or legal compliance
- Right to opt out of sale, sharing, and targeted advertising: Brokervio does not sell personal information, does not share it for cross-context behavioral advertising, and does not use it for targeted advertising, so there is nothing to opt out of; this commitment satisfies the opt-out rights under all state privacy laws
- Right to opt out of profiling: Brokervio does not use personal information for automated decision-making that produces legal or similarly significant effects
- Right to non-discrimination: we will not deny service, charge different prices, or degrade quality because you exercised your rights
- Right to appeal: if we decline a request, you may appeal by replying to our decision, and we will respond within the timeframe required by your state's law; if your appeal is denied, you may contact your state Attorney General
These rights are designed to meet or exceed the requirements of the California Consumer Privacy Act as amended by the CPRA, and the comprehensive privacy laws of Virginia, Colorado, Connecticut, Utah, Texas, Oregon, Montana, Florida, Delaware, Iowa, Nebraska, New Hampshire, New Jersey, Kentucky, Indiana, Tennessee, Minnesota, Maryland, Rhode Island, and every other state that enacts comparable legislation, by applying the most protective standard to all users.
Global Privacy Control: Where required by law, we treat a Global Privacy Control (GPC) browser signal as a valid opt-out request. Because we do not sell or share personal information, the signal does not change how we handle your data, but we honor it as required.
How to exercise your rights: Contact us at privacy@brokervio.com or through your account settings. We will verify your identity before responding, will not require you to create an account to submit a request if you are an end client, and will respond within 45 days (extendable once by 45 days where permitted, with notice). Authorized agents may submit requests on your behalf with proof of authorization.
Client Data requests: If you are an end client whose information was entered by a real estate professional, we may direct your request to that professional, since they control that data. We will assist them in fulfilling your request as required by law.
11. Children's Privacy
The Service is intended for licensed professionals and is not directed to anyone under 18. We do not knowingly collect personal information from children. If you believe a child has provided us information, contact us and we will delete it.
12. Users Outside the United States
The Service is operated from the United States and intended for use by US-licensed real estate professionals. If you access the Service from outside the US, you understand your information will be transferred to and processed in the United States.
13. Changes to This Policy
We may update this Privacy Policy from time to time. We will post the updated version with a revised "Last Updated" date and, for material changes, provide notice through the Service or by email. Continued use of the Service after changes take effect constitutes acceptance.
